The motor accident commission (MAC) and Allianz

The MAC is the sole Compulsory Third Party personal injury insurer in South Australia. Since 1 July 2003 Allianz has been contracted by the MAC to manage all its claims.

Compulsory third party (CTP) insurance

All motor vehicles must be registered and carry a policy of CTP Insurance.

The Motor Vehicles Act 1959 established CTP insurance in South Australia insuring the owner and the driver and in some cases even the passengers in a registered vehicle in respect to liability for personal injury caused to any other person in the course of the use of a motor vehicle.

The CTP scheme in South Australia is a fault based system. This means that in order to make a claim against the motorist, you must be able to prove negligence (at least in part) against the insured driver. If the circumstances of the accident are such that liability will be apportioned between you and another party, you are entitled to a percentage of your personal injury claim.

It is important to note that CTP insurance covers compensation arising from personal injury only. It does not cover property damage.

A person who intends to make a claim against the CTP insurer has only 3 years from the date of the accident to finalise a claim. After 3 years their legal rights are extinguished, unless they have filed a Summons and Statement of Claim.
